These terms govern your use of this website, ClinicAgenda and the services sold by Guaratech LTDA, CNPJ 55.598.113/0001-22, registered at Rua Venezuela, 69, Sala 06, Vila Brasil, Londrina – PR, 86.010-680, Brazil (“Guaratech”). By purchasing a service you agree to these terms.
1. Services
We sell (a) ClinicAgenda subscriptions, as listed on the pricing page, and (b) custom development projects, as set out in a written proposal. A signed proposal takes precedence over this site.
2. Prices and payment
Prices are in Brazilian reais (BRL). ClinicAgenda is billed per branch. Monthly plans are invoiced monthly, pro rata by days of use, plus any NFS-e above the plan's allowance. Yearly plans are paid in advance for 12 months. Invoices are due in 15 days and are charged to the card on file, processed by Stripe. We give at least 30 days' notice by email before any price change.
3. Trial, renewal and cancellation
Subscriptions renew automatically until cancelled. Free trials, cancellation, refunds and late payment are covered by the Refund & Cancellation Policy.
4. Your responsibilities
You must keep your account details accurate, protect your users' access, have a legal basis for the patient data you record in ClinicAgenda, and not use the services for anything illegal.
5. Patient data
In ClinicAgenda, the clinic is the controller of its patients' data and Guaratech acts as processor, under Brazil's General Data Protection Law (LGPD, Law 13,709/2018). See the Privacy Policy.
6. Intellectual property
ClinicAgenda is proprietary software owned by Guaratech. A subscription gives the clinic the right to use it while the subscription is active. For custom projects, ownership follows the proposal. Where the proposal does not say, the customer owns the work made specifically for them once the project is paid in full.
7. Promotions
Discounts and promotions are valid only for the period and conditions stated in the offer, cannot be combined with other offers unless stated, and have no cash value. The 30-day free trial applies once per branch.
8. Availability
We work to keep ClinicAgenda available at all times, but it may be interrupted for maintenance or by third-party failures. We back up data regularly.
9. Limitation of liability
To the extent permitted by law, our total liability for any claim is limited to the amount paid to Guaratech in the previous 12 months. We are not liable for indirect damages or lost profits.
10. Export and sanctions
You may not use the services in violation of applicable export control or sanctions laws.
11. Governing law
These terms are governed by Brazilian law. Disputes go to the courts of Londrina – PR, Brazil.
12. Changes
We may update these terms. The date at the top shows the current version. We announce material changes by email.
